D5Courier provides transportation of shipments utilizing on-demand and same-day services. All services are offered in accordance with these Terms and Conditions and subject to D5Courier’s published or specified rates.
D5Courier may, in its sole discretion, refuse service for any package:
Irregularly shaped items will be measured as if enclosed in a rectangular box. Oversized items may incur additional charges, including an “Oversized Shipment Surcharge.”
In addition, D5Courier reserves the right to refuse any package, regardless of weight or size, at the discretion of its drivers or administration if the shipment is deemed unsafe, impractical, improperly packaged, or otherwise unsuitable for transport.
(a) Standard Liability
Unless a Declared Value is provided in accordance with Section 2.2(b), D5Courier’s total liability for any shipment (including loss, theft, damage, misdelivery, or delay) is strictly limited to $100 CAD per shipment, regardless of cause, including negligence, gross negligence, or willful misconduct.
(b) Declared Value & Optional Coverage
Shippers may obtain additional coverage above $100 up to a maximum of $5,000 CAD per shipment, provided they declare the value in writing and pay the applicable charges, subject to D5Courier’s express acceptance. Any attempt to declare a value above this limit is null and void unless expressly approved in writing by D5Courier prior to tender. Declared value coverage applies only to the actual value of the shipment and does not extend to indirect, special, or consequential damages of any kind.
(c) Consequential and Indirect Damages
Under no circumstances shall D5Courier be liable for indirect, incidental, punitive, exemplary, or consequential damages, including but not limited to lost profits, business interruption, reputational harm, loss of data, or anticipated savings, even if advised of the possibility of such damages.
(d) Exclusions of Liability
D5Courier shall have no liability for: (i) prohibited items; (ii) perishable items or those requiring temperature control; (iii) loss or damage due to inadequate packaging; or (iv) loss or delay caused by events beyond D5Courier’s control, including acts of God, strikes, lockouts, weather conditions, or government actions.
No service shall be rendered in the transportation of tenders. Should a Shipper ship a “tender” without written approval from D5Courier, D5Courier will not be held responsible in any manner, financially or otherwise, for the consequences of failure to deliver by a stipulated time.
D5Courier may accept shipments containing dangerous goods or hazardous materials regulated under the Canada Transportation of Dangerous Goods Act and its associated Regulations, provided that the Shipper obtains D5Courier’s prior written approval before tendering such shipments.
Acceptance is at the sole discretion of D5Courier and may be subject to additional charges, packaging requirements, and documentation obligations. The Shipper is solely responsible for full compliance with all applicable laws and regulations governing the classification, packaging, marking, labeling, and documentation of dangerous goods.
Any dangerous goods tendered without prior written approval shall be refused, or if inadvertently accepted, shall be transported strictly at the Shipper’s risk, with D5Courier incurring no liability whatsoever.
Items classified as “consumer commodities” by Transport Canada are accepted for carriage by D5Courier.
No service shall be rendered in the transportation of prohibited items. If such items enter the D5Courier system, this does not constitute a waiver and D5Courier shall have no liability.
Prohibited Items include but are not limited to: currency and negotiable instruments (except cheques), human remains, firearms and ammunition, precious metals (articles containing more than 50% precious metal by weight), jewelry exceeding $500 in value, pornographic materials, and live animals, birds, or insects.
Items requiring pre-approval include alcohol, antiques, artwork, biological substances (Category B), ceramics, collectibles, diagnostic specimens, dry ice, furs, gem stones, glass, industrial diamonds, live plants and flowers, perishable food, pottery, unset stones, watches with precious stones, or any item that in D5Courier’s judgment may cause risk to equipment, personnel, or other shipments. Pre-approval must be obtained in writing from D5Courier prior to shipment.
D5Courier does not provide protective services for goods requiring temperature control. Such commodities are accepted solely at the shipper’s risk for loss or damage resulting from exposure to heat or cold.
No service shall be rendered in the transportation of shipments prohibited by law or regulation of any federal, provincial, or municipal government.
D5Courier reserves the right, but not the obligation, to inspect shipments for safety, security, or compliance. Such inspection does not create any duty or liability to detect improper packaging, prohibited items, or mislabeling.
Current rates are available on D5Courier’s website, by phone, or by written quotation. Rates are subject to change without notice.
D5Courier may refuse, suspend, or return shipments at its discretion if they are improperly packaged, prohibited, hazardous, unsafe, or impractical to transport.
Shippers are responsible for proper packaging that meets industry standards. D5Courier is not liable for loss or damage resulting from inadequate packaging. Labels must include full shipper and consignee details, including a valid phone number.
D5Courier reserves the right, at any time and in its sole discretion, to (i) reweigh or remeasure any shipment for accurate billing; (ii) recalculate charges to account for additional services provided, including but not limited to extra parcels, reattempted deliveries, extended distance, waiting time, or returns as described in Section 8; and (iii) adjust invoices accordingly where discrepancies arise between the Shipper’s declared information and D5Courier’s verified information.
Weights shall be rounded up to the next whole pound, and dimensions shall be rounded up to the next whole inch. Any adjustments may appear on the same invoice or a subsequent invoice, and the Shipper agrees to pay such adjustments in full.
Additional fees may apply, including but not limited to: after-hours service, third-party billing, address corrections, COD services, extended area surcharges, re-attempted deliveries, waiting time, special vehicle requests, additional handling, and large package surcharges.
Undeliverable shipments will be returned to the shipper at the shipper’s cost. If both shipper and consignee refuse the return, Section 18 (Unclaimed Goods & Lien Rights) applies.
At its sole discretion, D5Courier may consider issuing a credit or refund of shipping charges if delivery commitments are not met, subject to exclusions including weather delays, force majeure, consignee unavailability, strikes, or improper packaging.
Claims for loss, damage, or service failure must be reported verbally within 24–48 hours and in writing within 15 days, with all required shipment details.
All shipments are subject to applicable federal and provincial taxes.
Payment terms are as stated on the invoice. Customers remain responsible for payment if third parties fail to pay.
Customer is responsible for all expenses in collecting overdue amounts, including reasonable legal fees on a full indemnity basis.
An administration fee will be charged for declined payments, insufficient funds, or returned cheques.
Late payments shall accrue simple interest at the rate of 1.5% per month (18% per annum), or the maximum rate permitted by law, whichever is less.
D5Courier may amend these Terms at any time by posting an updated version on its website. Continued use of D5Courier’s services after such posting shall constitute acceptance of the revised Terms.
Some shipments may be handled by independent contractors. D5Courier reserves the right to subcontract transportation or related services to third parties. Such subcontracting does not affect the application of these Terms, and all limitations of liability herein apply equally to subcontractors.
D5Courier reserves the right to apply fuel or security surcharges without notice.
Undeliverable shipments unclaimed after thirty (30) days become the property of D5Courier, which may dispose of them without liability.
Carrier’s Lien: D5Courier shall have a general and continuing lien on any and all shipments in its possession for monies owed by the Shipper, including freight charges, storage fees, advances, and costs incurred. If such amounts remain unpaid, D5Courier may, after providing reasonable notice, sell or otherwise dispose of the goods to recover its costs.
Contracted agreements may have their own provisions. Unless otherwise agreed in writing, all contracts require 30 days’ cancellation notice.
The Shipper represents and warrants that: (i) all shipment information provided is complete and accurate; (ii) the shipment is properly packaged, labeled, and classified; (iii) the shipment complies with all applicable laws and regulations; and (iv) no shipment contains prohibited items. The Shipper assumes all responsibility for loss, damage, or liability arising from any breach of these warranties.
The Shipper shall indemnify, defend, and hold harmless D5Courier, its affiliates, employees, contractors, and agents from and against any and all claims, damages, losses, fines, penalties, liabilities, costs, and expenses (including legal fees on a full indemnity basis) arising out of or relating to: (i) the Shipper’s breach of these Terms; (ii) the shipment of prohibited or undeclared items; or (iii) the Shipper’s failure to comply with applicable laws and regulations.
D5Courier shall not be liable for any delay, failure, or inability to perform its obligations due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, labour disputes, strikes, riots, government actions, pandemics, network or transportation disruptions, or equipment failures. Performance shall be suspended during such events without liability.
D5Courier collects and uses personal information solely for the purposes of providing courier services, invoicing, and customer communication, in accordance with applicable privacy legislation. Personal information will not be sold, rented, or shared with third parties except as required to provide courier services, comply with law, or enforce these Terms. By using D5Courier’s services, the Customer consents to such collection and use.
By placing an order with D5Courier through its website, mobile application, or other electronic platform, the Shipper expressly agrees to these Terms and Conditions. The Shipper acknowledges that electronic acceptance shall have the same force and effect as a written signature.
All amounts are in Canadian dollars.
These Terms are governed by the laws of British Columbia and the federal laws of Canada. All disputes shall be brought exclusively in the courts of the Province of British Columbia, in the judicial district where D5Courier has its principal place of business.
If any provision of these Terms is held invalid, the remaining provisions remain in effect. If possible, such provision shall be modified by the court to the minimum extent necessary to make it enforceable.
Sections relating to payment, indemnity, limitation of liability, lien rights, governing law, privacy, and electronic acceptance shall survive termination or expiration of these Terms.
These Terms constitute the entire agreement between D5Courier and the Customer and supersede all prior representations, agreements, or understandings.
